Facial recognition bill (Bill no. 4420-D-2025) introduced

Bill No. 4243-D-2025 introduced, covering use of personal data in AI systems

The Bill on Personal Data Protection in Artificial Intelligence Systems (No. 4243-D-2025) has been introduced in the Chamber of Deputies. This bill aims to establish a legal regime applicable to the use of personal data of citizens by natural or legal persons that develop, operate, implement, or commercialise AI systems. It includes transparency obligations requiring operators to disclose system purpose, logic, automation level, use of personal data, and to enable the exercise of data subject rights. It also requires risk evaluations based on low, medium or high risk classification tiers, with mandatory registration in the National Registry of Artificial Intelligence Systems for medium- and high-risk systems. The authority is empowered to conduct audits, require documentation, and suspend systems posing serious risks, with sanctions ranging from warnings to suspension, prohibition of use, and fines proportionate to turnover, benefits, number of affected individuals, and intent or negligence.

The Bill establishing the Committee on Artificial Intelligence and New Technologies (2397-D-2025) has been introduced to the Argentina Chamber of Deputies. The Bill aims to redefine the duties of the existing Committee on Science and Productive Innovation to be responsible for issuing opinions on issues concerning scientific research and productive innovation, while the Committee on Artificial Intelligence and New Technologies will be responsible for issuing opinions on the entire technological lifecycle of AI and all other emerging technologies.

G20 countries reportedly sign declaration on AI

It has been reported that G20 countries, except Argentina, have signed a declaration at the 10th Summit of Presidents of the G20 Parliaments in Brazil that defends AI as a means to "promote sustainable development" provided that it is regulated to be "transparent, inclusive, ethical, responsible, reliable and centred on the human being". The declaration has yet to be released to the public, but will be delivered at the G20 Summit on 18-19 November 2024.

Global data protection authorities issue statement on data scraping, covering AI

A coalition of 17 global data protection authorities have issued a follow-up statement on data scraping (Australia, Canada, United Kingdom, Hong Kong, China, Switzerland, Norway, New Zealand, Colombia, Jersey, Morocco, Argentina, Mexico, Guernsey, Spain, Monaco, Israel). The statement builds on a joint statement by the authorities in August 2023 urging social media platforms to implement safeguards against data scraping. This follow-up statement specifies that (1) organizations should deploy a combination of safeguarding measures against unlawful scraping, regularly reviewing and updating them to keep pace with advances in scraping techniques and technologies; (2) while AI is used by some sophisticated data scrapers to evade detection, it can also enhance protections against unlawful scraping; (3) the obligation to protect against unlawful scraping applies to both large corporations and SMEs, with lower-cost measures available for SMEs with assistance from service providers; (4) contractual terms authorizing scraping of personal data cannot alone render such scraping lawful, but they can serve as an important safeguard; (5) organizations permitting scraping of personal data must ensure they have a lawful basis, are transparent, and obtain consent where required by law; (6) organizations should implement adequate measures, including contractual terms and monitoring, to ensure compliance with data protection and privacy laws; (7) providing access via an API can allow organizations greater control over data and facilitate detection and mitigation of unauthorized scraping; and (8) organizations using scraped data or their own platform data to train AI must comply with data protection, privacy laws, and AI-specific laws, following available regulatory guidelines.

Argentina releases guidance on transparency and personal data protection in AI

The Agency of Access to Public Information of Argentina has released a preliminary guide for public and private entities on transparency and personal data protection for responsible AI, subject to public consultation. The Guide (1) applies to public and private organisations developing and using AI, (2) sets out principles of lawfulness, consent, and transparency and (3) offers recommendations for implementing such principles into different steps of the AI lifecycle, from the design stage through to verification and maintenance stages. The consultation closes on 30 October 2024.

International Agreement

Latin American countries adopt sweeping AI declaration

Representatives of 17 Latin American countries (Argentina, Brazil, Chile, Colombia, Costa Rica, Cuba, Curaçao, Ecuador, Guatemala, Guyana, Honduras, Panama, Paraguay, Peru, Dominican Republic, Suriname and Uruguay) have signed the Cartagena Declaration on AI governance. The declaration includes (1) adherence to UNESCO's ethics recommendations from the AI for Good Global Summit, (2) alignment with existing soft law instruments like the OECD's AI recommendations, and (3) continuation of similar AI initiatives previously signed in Montevideo and Santiago. The text of the declaration has yet to be publicly revealed.

AAIP receives complaint about Meta's use of personal data in AI training

Argentina's data privacy agency, the Agency for Access to Public Information (AAIP), has received a complaint filed by individuals Facundo Malaureille Peltzer and Daniel Monastersky against Meta in relation to Meta's use of personal data for training AI. The complaint consists of 22 points and asks Meta for explanations about its practices of collection and use of personal data for AI training. Among those points includes (1) details about the updated Privacy Policy and evidence of users’ consent, (2) an Impact Analysis Assessment (PIA) in accordance with Argentine guidelines, (3) technical explanations on data anonymization processes and guarantees of their irreversibility, (4) clarifications on how the re-identification of anonymized data is prevented, (5) information on the handling of metadata and sensitive data in the anonymization process, and (6) details on data retention and destruction policies. The complaint also requests the AAIP to conduct an independent audit of Meta's processes in the country and establish guidelines on acceptable anonymization standards in Argentina, within the framework of its powers as the enforcement authority of Law 25,326. AAIP will evaluate and respond to the complaint.

Argentina establishes AI security unit

Under Resolution 710/2024, Argentina's Ministry of Security has established the Artificial Intelligence Unit Applied to Security (UIAAS), which is a new unit tasked with integrating AI into crime investigations, including analysing camera footage with real-time facial recognition, drone surveillance, scanning social media, applying machine learning to analyze historical crime data to predict future crimes, collecting data to create suspect profiles, scouring the dark web and preventing cyberattacks.
