Mexican Chamber of Deputies receives initiatives from the President to protect artists' rights against AI misuse

The Mexican Chamber of Deputies has received two initiatives from the President aimed at protecting the rights of artists, particularly those involved in dubbing, against unauthorized use of their work through artificial intelligence. The proposed reforms to the Federal Labor Law and the Federal Copyright Law seek to safeguard the labor rights of performers and address the challenges posed by AI technologies in the creative industry.

Mexico is working on a law to regulate the use of AI in dubbing, animation, and voiceovers

It is reported that the Mexican government is preparing a law to regulate the use of AI in dubbing, animation, and voiceovers to prevent unauthorised voice cloning and safeguard creative rights. Working with the National Copyright Institute and more than 128 associations, it aims to reform copyright legislation before the end of 2025. The plan would strengthen protections for actors, voiceover artists, and creative workers, while addressing contract conditions and establishing a ‘Made in Mexico’ seal for cultural industries. A bill that is expected to prohibit synthetic dubbing without consent, impose penalties for misuse, and recognise voice and image as biometric data.

Mexico Supreme Court rules that works created by AI cannot be granted copyrighted

Mexico's Supreme Court has ruled that works generated exclusively by AI cannot be granted copyright protection, as authorship is reserved solely for humans. The court emphasized that AI systems lack the human attributes of creativity, originality, and individuality necessary for authorship. This decision establishes a legal precedent in Mexico, affirming that copyright is a human right derived from human creativity, intellect, feelings, and experiences. The ruling arose from a case where the Copyright National Institute (INDAUTOR) denied registration for an AI-created work, stating that the Federal Copyright Law requires human creation and originality as expressions of the author's individuality and personality.

Global data protection authorities issue statement on data scraping, covering AI

A coalition of 17 global data protection authorities have issued a follow-up statement on data scraping (Australia, Canada, United Kingdom, Hong Kong, China, Switzerland, Norway, New Zealand, Colombia, Jersey, Morocco, Argentina, Mexico, Guernsey, Spain, Monaco, Israel). The statement builds on a joint statement by the authorities in August 2023 urging social media platforms to implement safeguards against data scraping. This follow-up statement specifies that (1) organizations should deploy a combination of safeguarding measures against unlawful scraping, regularly reviewing and updating them to keep pace with advances in scraping techniques and technologies; (2) while AI is used by some sophisticated data scrapers to evade detection, it can also enhance protections against unlawful scraping; (3) the obligation to protect against unlawful scraping applies to both large corporations and SMEs, with lower-cost measures available for SMEs with assistance from service providers; (4) contractual terms authorizing scraping of personal data cannot alone render such scraping lawful, but they can serve as an important safeguard; (5) organizations permitting scraping of personal data must ensure they have a lawful basis, are transparent, and obtain consent where required by law; (6) organizations should implement adequate measures, including contractual terms and monitoring, to ensure compliance with data protection and privacy laws; (7) providing access via an API can allow organizations greater control over data and facilitate detection and mitigation of unauthorized scraping; and (8) organizations using scraped data or their own platform data to train AI must comply with data protection, privacy laws, and AI-specific laws, following available regulatory guidelines.

Mexico Proposes Groundbreaking AI Regulation Bill Aligned with EU, Chile Models

Senator Ricardo Monreal of the Morena party introduced the 'Federal Law to Regulate Artificial Intelligence" in Mexico. The bill proposes to (1) apply extraterritorially; (2) put the Federal Telecommunications Institute (FTI) in charge of enforcing the act; (3) creates a National Artificial Intelligence Commission, as an advisory body to the FTI, which will be formed by scientists; (4) proposes to classify AI systems according to risk tiers (Unacceptable Risk, High Risk and Low Risk; (5) require prior authorization from the FTI for providers to offer AI systems in Mexico, even in those cases where systems is offered free of charge, and (6) sets penalty for non-compliance up to 10% of the annual income of the infringing entities.

2025 APEC Digital and AI Ministerial Statement

At the APEC summit in Incheon, South Korea, the Asia-Pacific Economic Cooperation adopted the 2025 Digital and AI Ministerial Statement, highlighting the role of AI in driving innovation and addressing socio-economic challenges. The statement emphasises secure and responsible adoption of AI and other digital technologies to enhance productivity, efficiency, resilience, and economic development. It encourages member economies to integrate these technologies with balanced, human-centred approaches to workforce development, education, and lifelong learning. It also promotes cooperation and information-sharing on digital policies to strengthen regional collaboration, cross-border trade, and investment, while fostering greater understanding of the benefits of emerging technologies.

Declaration of Ethics and Best Practices for the Use and Development of AI (SECIHTI):

The Secretaría de Ciencia, Humanidades, Tecnología e Innovación (SECIHTI) has introduced ten principles to guide the ethical deployment of AI in Mexico: (1) AI should expand rights, never reduce them; (2) Every decision supported by AI must have human responsibility and be based on clear institutional frameworks; (3) If a decision cannot be explained, it should not be automated; (4) AI is best governed when decisions are made collectively; (5) AI is only valuable if it generates well-being for people; (6) Before automating, it is necessary to understand who and what it affects; (7) Strategic technology must respond to the needs of the country; (8) The development of AI requires strengthening education and knowledge in the country; (9) AI cannot ignore the country's cultural and linguistic diversity; and (10) Data is a public good that must be handled responsibly.
